These Terms and Conditions ("Terms") govern all services provided by Holina Holistic Care Center ("Holina Clinic," "the Clinic," "we," "our," "us") at 14/1 Moo 8 Sri Thanu, Koh Phangan, Surat Thani 84280, Thailand.
These Terms apply to Hyperbaric Oxygen Therapy (HBOT), IV Infusion and NAD+ therapy, and Neurofeedback sessions. Service-specific terms are set out in Sections 4–6. All other sections apply to all services.
By booking, purchasing, or attending any service at Holina Clinic — whether in person, via WhatsApp, email, or any other channel — you ("Client," "you") confirm that you have read, understood, and agree to be bound by these Terms. A booking confirmation sent or acknowledged via WhatsApp or email constitutes your acceptance. If you do not agree, do not book or attend.
1.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand.
1.2 Amendments. Holina Clinic reserves the right to update these Terms at any time. Material changes will be communicated via the website (holinaclinic.com) or direct client communication. Your continued use of services after such notice constitutes acceptance of the updated Terms.
1.3 Severability. If any provision of these Terms is found to be unenforceable under applicable law, the remaining provisions continue in full force and effect.
2.1 Protocol Package. A Protocol Package consists of ten (10) HBOT sessions. Clients purchasing a Protocol Package commit to a fixed daily time slot for the duration of the protocol (approximately two weeks). After completing all ten sessions, the client may request a different time slot for any subsequent package, subject to availability.
2.2 Bulk Package. A Bulk Package consists of a pre-purchased block of HBOT sessions used on an availability basis. Bulk sessions are not assigned a fixed time slot and must be booked no more than 48 hours in advance, subject to chamber availability. No time slot is guaranteed.
2.3 Package Validity. All multi-session packages are valid for six (6) months from the date of purchase. Unused sessions remaining after this period will be forfeited.
2.4 Extensions. Extensions are not guaranteed and may be granted solely at Holina Clinic's discretion in documented exceptional medical circumstances. All extension requests must be submitted in writing before the package expiration date.
2.5 Session Frequency. While daily use is permitted, Holina Clinic recommends a rhythm of 5 sessions on and 2 days off for HBOT. For IV and NAD+ therapy, frequency recommendations will be provided during your initial consultation.
2.6 Transferability. Packages may be transferred to another person, subject to: (a) the intended recipient completing a full medical screening and receiving clearance from Holina Clinic prior to use; (b) the recipient agreeing to and acknowledging these Terms; (c) Holina Clinic reserving the right to decline a transfer if the recipient is medically unsuitable.
2.7 Refunds. All purchases are final. Refunds will not be issued except where required by applicable Thai law, including circumstances where the Clinic is unable to deliver the purchased service.
3.1 Protocol Package Bookings. Clients on a Protocol Package commit to a fixed daily time slot for the full ten (10) sessions. This slot is reserved exclusively for the client and cannot be changed mid-protocol. After completing the ten sessions, the client may request a different time slot for any new package, subject to availability.
3.2 Bulk Package Bookings. Bulk Package sessions are booked on an availability basis. Clients must book each session no more than 48 hours in advance. No recurring slot is reserved. Holina Clinic does not guarantee availability at any specific time.
3.3 Rescheduling. Requests to change a fixed Protocol time slot are not permitted mid-protocol. Holina Clinic reserves the right to deny rescheduling requests to maintain operational scheduling.
3.4 Cancellation Notice. A minimum of 24 hours' notice is required for any cancellation or rescheduling of any service.
3.5 No-Shows. Failure to attend a scheduled session without 24 hours' prior notice will result in that session being automatically deducted from the package.
3.6 Punctuality. Sessions operate on a strict schedule. For HBOT: clients arriving more than five (5) minutes late will not be admitted and the session will proceed without them. For IV and Neurofeedback: late arrival may result in a shortened session at the practitioner's discretion.
3.7 Personal Delays. Holina Clinic is not responsible for sessions missed due to travel delays, traffic, ferry disruptions, or other personal circumstances.
4.1 Health Declaration Form. All first-time HBOT clients must complete and sign Holina Clinic's Health Declaration Form prior to their first session. By signing, the client confirms that all health information provided is accurate and complete, acknowledges the known risks associated with HBOT (including those listed in clause 4.3 below), and agrees to these Terms. Clients who cannot or do not complete the Health Declaration Form will not be admitted for treatment.
4.2 Contraindications. HBOT is contraindicated for clients with the following conditions (this list is not exhaustive — Holina Clinic's clinical team may identify additional contraindications during screening):
4.3 Known Risks. HBOT involves breathing concentrated oxygen under elevated atmospheric pressure. Known risks include: (a) barotrauma — pressure-related injury to the ears, sinuses, or teeth, which may present as ear pain, fullness, or discomfort during pressurisation; (b) oxygen toxicity at high exposures, which may in rare cases affect the central nervous system; and (c) in rare cases, seizure. These risks are disclosed in the Health Declaration Form. Clients acknowledge these risks by signing the Form and by attending treatment.
4.4 Client Obligations During Sessions. Clients must: (a) notify the chamber operator immediately of any ear discomfort, pain, dizziness, or physical distress during pressurisation or at any point during the session; (b) follow all equalisation and operator instructions throughout the session; (c) not bring prohibited items (including electronic devices, watches, or flammable materials) into the chamber. Holina Clinic is not liable for barotrauma or any pressure-related injury arising from a client's failure to communicate discomfort or follow operator instructions in a timely manner.
4.5 Post-Session Protocol. Clients should not fly for a minimum of 24 hours following an HBOT session. Holina Clinic is not responsible for any adverse effects arising from a client's failure to observe this protocol.
4.6 Right to Refuse or Terminate. Holina Clinic reserves the right to refuse, delay, shorten, or terminate any HBOT session if clinical staff determine that treatment may pose a health risk (including active cold, flu, ear congestion, or sinus pressure). Such actions do not constitute grounds for a refund.
4.7 Session Format. Unless a private session is specifically booked, HBOT sessions take place in a shared chamber accommodating up to four (4) participants. A shared session does not guarantee any particular combination of participants.
4.8 Interrupted Sessions. Sessions interrupted before commencement may be rescheduled at the Clinic's discretion. Sessions interrupted after commencement are considered delivered.

5.1 Pre-Treatment Health Screening. Before receiving any IV infusion or NAD+ therapy, clients must complete a pre-treatment health questionnaire disclosing: (a) all known allergies, including to vitamins, minerals, and compounds commonly used in IV formulations; (b) all current medications and supplements; (c) relevant medical conditions, in particular kidney or liver conditions, cardiovascular conditions, and active infections; (d) pregnancy or suspected pregnancy.
5.2 Known Risks. IV infusions carry risks including but not limited to: bruising, swelling, or discomfort at the infusion site; infection; allergic reaction; and in rare cases, serious allergic reaction (anaphylaxis). Clients with a known history of allergic reactions must disclose this before treatment. By proceeding with IV therapy, you acknowledge awareness of these risks.
5.3 NAD+ Infusions. NAD+ is administered via slow intravenous infusion. Clients may experience temporary sensations during infusion, including mild chest tightness, nausea, warmth, or flushing. These are expected reactions to the rate of infusion and subside when the infusion is slowed or paused. Clients must immediately notify the attending nurse of any distress. Do not withhold symptoms.
5.4 During Treatment. Clients must remain on-site and accessible to nursing staff for the full duration of any IV infusion. Holina Clinic reserves the right to pause, adjust, or discontinue an infusion at any time if clinical staff consider it appropriate.
5.5 Clinical Oversight. All IV infusions are administered by a registered nurse under the oversight of a licensed physician.

6.1 Nature of Service. Neurofeedback is a non-invasive brain-training modality that uses real-time feedback to support cognitive and neurological wellbeing. Sessions are conducted by trained operators.
6.2 Required Disclosures. Before commencing neurofeedback, clients must disclose any personal or family history of epilepsy, seizure disorders, or significant neurological conditions. Holina Clinic reserves the right to decline treatment pending medical consultation.

7.1 All Sales Final. All service purchases are final. No refunds will be issued except as required by applicable Thai law.
7.2 Price Adjustments. Holina Clinic reserves the right to modify pricing at any time. Pre-purchased packages will be honoured at the original purchase price until the package expires or sessions are fully used.
8.1 Liability Cap. To the maximum extent permitted by applicable law, Holina Clinic's total aggregate liability to any client in connection with any service — whether arising in contract, tort (including negligence), or otherwise — shall not exceed the total amount paid by that client for the specific service giving rise to the claim in the twelve (12) months preceding the relevant incident.
8.2 Excluded Damages. Holina Clinic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of income, loss of opportunity, or reputational harm, however arising.
8.3 Exceptions. Nothing in these Terms limits Holina Clinic's liability for death or personal injury caused by the Clinic's gross negligence or wilful misconduct.
By attending any service at Holina Clinic, you agree to indemnify and hold harmless Holina Clinic, its directors, staff, agents, and affiliates from and against any claims, damages, losses, and expenses (including reasonable legal costs) arising from or in connection with: (a) your failure to fully and accurately disclose your medical history, conditions, medications, or allergies; (b) your failure to follow the instructions of Holina Clinic's clinical or operational staff; or (c) your misrepresentation of your health status or eligibility for treatment.
10.1 Force Majeure. Holina Clinic is not liable for failure to deliver services due to circumstances beyond its reasonable control, including but not limited to: power outages, internet failures, severe weather, equipment malfunction, natural disasters, government or public health orders, civil unrest, or disruption to transportation infrastructure (including ferry services).
10.2 Rescheduling. In force majeure circumstances, Holina Clinic will make reasonable efforts to reschedule affected sessions. No refunds will be issued solely on account of a force majeure event.
10.3 Operational Safety. Holina Clinic reserves the right to delay, shorten, or terminate any session due to safety concerns or equipment maintenance requirements. Such actions do not constitute grounds for a refund.
11.1 Legal Basis. In compliance with the Personal Data Protection Act B.E. 2562 (2019) of Thailand ("PDPA"), Holina Clinic collects and processes personal and health data for the following purposes:
11.2 Data Collected. We may collect: full name, contact details (phone, email), date of birth, nationality, health history, medical conditions, current medications, allergies, and session records.
11.3 Access. Your data is accessible only to Holina Clinic's clinical and administrative staff directly involved in your care and service management. It will not be shared with third parties without your consent, except as required by law.
11.4 Retention. Health and session data is retained for a minimum of five (5) years following your last session, or as otherwise required by applicable Thai law.
11.5 Your Rights. You have the right to access, correct, withdraw consent, or request deletion of your personal data, subject to legal retention requirements. To exercise your rights, contact: info@holinaclinic.com.
11.6 No Sale of Data. Your personal and health data will not be sold, rented, or shared with third parties for commercial or marketing purposes.
Clients under 18 years of age may only receive treatment at Holina Clinic with the written consent of a parent or legal guardian. The parent or legal guardian must be present at the first session, must review and acknowledge these Terms on behalf of the minor, and accepts personal responsibility for the minor's participation and compliance with all Clinic policies.
13.1 Good-Faith Negotiation. In the event of any dispute arising from or relating to these Terms or any service provided by Holina Clinic, both parties agree to first attempt resolution through good-faith direct negotiation. The disputing party shall notify the other in writing, and the parties shall have thirty (30) days from such notice to reach a resolution.
13.2 Mediation. If the dispute is not resolved through negotiation within thirty (30) days, either party may refer the matter to mediation conducted by a mutually agreed mediator in Surat Thani Province, Thailand. Mediation costs shall be shared equally unless otherwise agreed.
13.3 Legal Proceedings. Only if mediation fails to produce a resolution may either party initiate legal proceedings before the competent courts of Thailand.
14.1 When These Terms Apply. These Terms take effect when you (a) confirm a booking via WhatsApp, email, or any other channel; (b) make payment for any service; or (c) attend a session at Holina Clinic — whichever occurs first.
14.2 In-Person Acknowledgment. For in-person first visits, clients may be asked to sign a physical or digital acknowledgment of these Terms before commencement of treatment.
14.3 Confirmation. By accepting these Terms, you confirm that: (a) you are 18 years of age or older, or have a parent or legal guardian's consent under Section 12; (b) you have provided accurate and complete health information; and (c) you have had sufficient opportunity to read and understand these Terms.
14.4 Additional Consent Forms. These Terms should be read alongside any service-specific consent or intake forms provided at the time of booking or treatment.
